Terms of Use – Gilboa Indices (TGI)

1. Limited License

You are granted a limited, non-exclusive, non-transferable, revocable license, without the right to sublicense, to access and use the TGI indices and website content (including data, tables, charts, graphs, illustrations, and other materials – “Content”) solely for internal, informational, and non-commercial purposes. Use of the indices or Content is subject to full compliance with these terms.

2. Restrictions on Use

Without a written license from TGI, you may not:

  • Copy, reproduce, distribute, publish, sell, or create derivative works from the Content;
  • Use the Content for commercial purposes, operate a commercial database, distribute to third parties, or for regulatory filings;
  • Imply or suggest that TGI endorses, approves, or is affiliated with any product, service, or investment offered by you;
  • Circumvent, interfere with, or attempt to bypass website security, or access any part of the website without authorization.

    3. Intellectual Property

    All indices, index names, logos, and trademarks on the website are the property of TGI or third-party rights holders. No use is permitted without prior written authorization. All content on the website is protected by copyright and other intellectual property laws.

    4. Privacy and Data Collection

    TGI may collect personal information when you register on the website, including name, email, address, or phone number. Such information will not be shared with third parties without your consent, except as required by law. Anonymous or aggregated data may be used for marketing, research, or analytical purposes.

    5. Content and Indices Disclaimer

    All Content and indices are provided “as is.” TGI makes no representations or warranties regarding the accuracy, completeness, or reliability of the data. The indices do not constitute investment advice, a recommendation to buy or sell any security, or a financial offer of any kind. Past performance is not indicative of future results. Use of the indices or Content is at your sole risk.

    6. Indemnification and Limitation of Liability

    You agree to indemnify TGI, its affiliates, and representatives from any claims, liabilities, losses, or damages arising from a breach of these terms or unauthorized use of the indices or Content. TGI shall not be liable for any indirect, incidental, consequential damages, lost profits, lost data, or loss of revenue.

    7. Disputes and Governing Law

    All disputes shall be resolved by binding arbitration in Tel Aviv, Israel, under Israeli law. Class or collective actions are not permitted. TGI reserves the right to seek judicial relief to prevent unauthorized use or infringement of its rights.

    8. Commercial Licensing and Conditional Use

    TGI offers licenses for commercial use of the indices, product replication, benchmarking, and custom index development. For more information on licensing and commercial use, contact: db@gilboafunds.com.

    9. Linking to TGI Website

    Any link to the TGI website must clearly point to www.gilboafunds.com and must not imply sponsorship, endorsement, or affiliation with TGI.

תנאי שימוש – מדדי גלבוע  (TGI)

1.  רישיון מוגבל לשימוש
אתה מקבל רישיון מוגבל, לא בלעדי, בלתי ניתן להעברה וללא זכות להעניק רישיונות משנה, לגשת למדדי TGI ולתוכן האתר (נתונים, טבלאות, גרפים, תרשימים, איורים ושאר החומרים – להלן: “תוכן”) אך ורק למטרות מידע פנימי, אינפורמטיבי ולא מסחרי. השימוש במדדים או בתוכן מחייב ציות מלא לכל תנאי השימוש המפורטים כאן.

2. הגבלות שימוש
ללא רישיון כתוב מTGI- , אסור לך:

  • לשכפל, להעתיק, להפיץ, לפרסם, למכור או ליצור יצירות נגזרות מהתוכן;
  • להשתמש בתוכן במדיה מסחרית, הפעלת מסדי נתונים מסחריים, הפצה לצדדים שלישיים או לצרכים רגולטוריים;
  • ליצור רושם כי TGI תומכת, מאשרת או קשורה לכל מוצר, שירות או השקעה המוצעים על ידך;
  • לעקוף, לפגוע או לנסות לעקוף את האבטחה של האתר או לקבל גישה בלתי מורשית.

3. זכויות קניין רוחני
כל המדדים, שמות המדדים, לוגואים וסימנים אחרים באתר הם קנייניים ל- TGI או לבעלי זכויות צד שלישי. אין להשתמש בהם ללא אישור כתוב מראש. כל התוכן באתר מוגן בזכויות יוצרים ובחוקי קניין רוחני אחרים.

4. פרטיות ואיסוף מידע
TGI עשויה לאסוף מידע אישי בעת הרשמה לאתר, כולל שם, דואר אלקטרוני, כתובת או טלפון. מידע זה לא יימסר לצד שלישי ללא הסכמתך, למעט לצורכי ציות לחוק. מידע אנונימי או סטטיסטי עשוי לשמש למטרות שיווק, פרסום או מחקר.

 5. דיסקליימר על תוכן ומדדים
התוכן והמדדים נמסרים “כפי שהם”  (As Is), TGI אינה מתחייבת לדיוק, נכונות או שלמות הנתונים. אין במדדים כדי להוות ייעוץ השקעות, המלצה לרכישה או מכירה, או הצעה פיננסית כלשהי. ביצועים קודמים אינם אינדיקציה לתוצאות עתידיות. השימוש במדדים או בתוכן נעשה על אחריות המשתמש בלבד.

6.  שיפוי והגבלת אחריות
אתה מתחייב לשפות את ,TGI חברות קשורות שלה ונציגיה בגין כל תביעה, חבות, הפסד או נזק הנובע מהפרת תנאי השימוש או שימוש לא מורשה במדדים או בתוכן. TGI לא תהיה אחראית לנזקים עקיפים, מקריים, תוצאתיים, אובדן רווחים, אובדן נתונים או הכנסות.

7. מחלוקות וסמכות שיפוט
כל מחלוקת בין הצדדים תיפתר בבוררות מחייבת בתל אביב, ישראל, לפי חוקי ישראל. אין אפשרות להגשת תביעה ייצוגית או מאוחדת. TGI רשאית לפנות לבית המשפט לצורך מניעת הפרות של זכויותיה.

8. רישוי מסחרי ושימוש מותנה
TGI מציעה רישיונות לשימוש מסחרי במדדים, שכפול מוצרים, בנצ’מרקינג ופיתוח אינדקס מותאם אישית. פרטים נוספים ורישוי מסחרי ניתן לקבל בכתובת:. db@gilboafunds.com

9. קישוריות לאתר TGI
